The general terms and conditions deal with the operation of the Happy Frenchie Paw online store and the business relationship between Happy Frenchie Paw, Darja Draksler s.p. (in the following: Happy Frenchie Paw/The company/The seller), registered users (in the following: users) and buyers of goods or services (in the following: buyer/costumer).
The buyer is bound by the general conditions that are valid at the time of purchase (placing an online order). When placing an order, the user is reminded of the general terms and conditions of business and confirms his / her acquaintance with them by placing an order.
Availability of information
The seller undertakes to always provide the buyer with the following information:
- company identity (company name and registered office, tax number),
- contact information that allows the user to communicate quickly and efficiently with the company (e-mail),
- essential characteristics of the company’s goods or services (including after-sales services and guarantees),
- availability of the company’s products (any product offered on the website should be available within a reasonable time),
- terms of delivery of the company’s product (method, place and delivery time),
- all prices listed in the company’s online store must be clearly and unambiguously set and it must be clearly shown whether they already include taxes and transportation costs,
- method of payment and delivery,
- time duration of the offer,
- deadline within which it is still possible to withdraw from the contract and conditions for withdrawal; in addition, information on if and how much it costs the customer to return the company’s product,
- an explanation of the procedure to appeal, including any details of the company’s contact person or customer service.
Types of users
By registering on the Happy Frenchie Paw website, you become a member. Registered members as well as guests who make a quick purchase and do not register before the purchase have the right to purchase in the Happy Frenchie Paw online store.
Upon registration in the online store, the visitor obtains a username that is the same as his e-mail address, and a password. If a user wishes to change their email address or password at any time, they can do so in their user profile.
Prices
All product prices in the Happy Frenchie Paw online store are expressed in EUR and are final (the seller is not a taxable person). The price in the online store is the same for both registered members and guests. Prices do not include delivery costs and are valid at the time of placing the order without a predetermined validity (until canceled). All orders are subject to the prices listed in the company’s online store. In the event that the price of the item changes during the processing of the order, the provider will notify the buyer.

Offers and special prices
The special offer of products and their prices are valid until the cancellation or sale of stock. The company reserves the right to withdraw products from the offer without prior notice.
Order and prices
Purchase agreement between the seller and the buyer is concluded at the moment when Happy Frenchie Paw sends the customer the first e-mail confirming the order. From that moment on, all prices and other business conditions are fixed and apply to both the seller and the buyer. The sales contract (i.e. the first electronic order status message) is stored electronically on the Happy Frenchie Paw server and is available to consumers upon their written request.
Promotional codes
Promotional codes bring various benefits when purchasing and are usually time-limited. You can find the active promotional code on the company’s website, on the company’s social networks, the title page of the advertising message, in the company’s e-notifications or in other media. Discounts can be expressed in different ways (in percentages, certain amounts or as free items).
It is not possible to change the promotional code for cash. The promotional code can only be redeemed in full. In the event that the value of the purchase is higher than the value of the coupon, the holder of the promotional code must pay the difference. Purchase value must be higher than code value. Codes and discounts do not add up – only one code / discount is possible for one order.
Dispatch of goods
All orders placed during the working days before 12 noon will be shipped no later than three days from the order in the case of payment by card. Orders where direct bank transfer is indicated are sent in three days after receiving the transfer to the bank account. Orders placed during weekends and holidays are shipped within three working days at the latest.
For some products, like personalized items, there are expected longer delivery times. Personalized products are shipped no later than seven working days from the order.
Due to the fact that our products are handmade, in the event of a larger number of orders, we reserve the right to extend the deadlines for production and shipment, which we inform the user as soon as possible. In the event that the new delivery time does not suit the user, he can withdraw from the sales contract at no cost.
Delivery
The delivery of shipments is made by Pošta Slovenije.
Packaging and delivery costs are 2,99€.
Personal collection is not possible.
Delivery over 80€ is free.
Note: These conditions and the costs of packaging and delivery are valid only within the Republic of Slovenia.
International delivery
The delivery price of international shipments is automatically calculated in the shopping cart when entering the recipient’s country. Any customs costs, taxes and additional delivery costs are responsibility of the buyer. By purchasing products on the Happy Frenchie Paw website, you confirm that you may pay customs duties and taxes.
If the costumer does not pick up the package and the package returns to us, we reserve the right to deduct postage costs when refunding the money.

Methods of payment
The following payment options are available in the Happy Frenchie Paw online store:
- direct bank transfer to the company’s account,
- credit card (Mastercard, Visa, American Express and Maestro – if the payer’s payment card allows it) via Stripe.
Security
The seller uses appropriate technological and organizational means to protect the transfer and storage of personal data and payments.
Secure authorizations and credit card transactions are handled by Happy Frenchie Paw and Stripe. Credit card authorizations are performed in real time with immediate verification of data at banks. Card information is not stored on the server of Happy Frenchie Paw.
Issuing an invoice
After delivery and payment of the ordered items upon receipt, Happy Frenchie Paw sends an invoice to the buyer in physical form to the specified delivery address. If the customer chooses a delivery address that is not the same as the customer’s address, the invoice is sent to the customer only in electronic form. The invoice breaks down the price and all costs related to the purchase. The buyer is obliged to check the correctness of the data before placing the order.

Communication
Happy Frenchie Paw will only contact the user via means of distance communication if the user explicitly consents. Happy Frenchie Paw will explicitly respect the user’s wish not to receive advertising messages. Advertising emails will contain the following components:

The purchasing process
Shopping cart
Product selection: In the Happy Frenchie Paw online store, the user selects the product and clicks on the “Add to cart” button. By clicking on the “Show cart” button, the system redirects him/her to the cart, where it displays its contents. To complete the purchase, the user clicks on the button “Continue to checkout” and the system will take him/her to the checkout, where he/she just fills in the necessary information.
Removing a product from the shopping cart: In the Happy Frenchie Paw online store, in the upper right corner, there is a shopping cart icon in which (after clicking on the icon) the user is shown products that were added to the shopping cart while browsing the online store. If the user wants to remove a certain product from the shopping cart, he/she must click on the shopping cart icon and in the shopping cart in front of the product click on the “remove” or product quantity by clicking on – set the product quantity to 0 and then click on “Update cart” to confirm your action.
Completing the order
To complete the order, you must click “Continue to checkout” in the cart and fill in the required fields.
Delivery address: The user must provide the required contact information, marked with an asterisk (name, surname, country, address, place, postal code, e-mail address and telephone number), which we need to confirm to complete the order and delivery of the product.
Delivery cost: The delivery price is automatically calculated (Pošta Slovenije). To calculate the cost of international delivery, it is necessary to indicate the appropriate country.
Method of payment: The user can choose between two methods of payment: payment by direct bank transfer or credit card.
Coupons/Promotional codes: If the user has a valid discount coupon, he/she must enter it in the appropriate field and click the “Apply coupon” button. When the user redeems the promotional code, the value of the promotional code is deducted from the price of his/her order. Remains the amount which need to be settled.
Order overview: The right side shows the products that the user added to the shopping cart while browsing the online store. The price of an individual product, the cost of postage, and the total cost of payment are evident before the customer completes the order.
Completion of the order: The user can view the submitted delivery information, the payment method he/she has chosen and the contents of the shopping cart. The user confirms the order by clicking on the ‘Complete purchase’ button. If the order has been successfully completed, the text “Thank you. Your order has been accepted.” is shown.
If the user does not complete the purchase, the system sends an email about the unfinished purchase. We are always available for additional information.

Purchase status
After placing the order, the buyer receives a notification by e-mail that the order has been accepted. Information on the status and content of the order is always available to the registered customer on the page. Happy Frenchie Paw may call the customer on the contact telephone number to verify the information or to ensure the accuracy of the delivery.
The purchase procedure for legal entities is exactly the same, except that you also enter the name of the company and the tax number of the company in the cash register. The same payment options are available for legal entities.
Order status and canceling the order
Queue: After completing the order, the customer receives a notification to the entered email. In this case, the order is accepted in the queue.
Order confirmed: The seller checks the availability of the ordered items and confirms the order or rejects it with a reason.
Shipped: The seller prepares, dispatches the goods within the agreed deadline and notifies the buyer by email.
Cancelation
The customer has the right to withdraw from the contract until the goods are sent. The order must be canceled by email to info@happyfrenchiepaw.com, by adding order number, name and surname and delivery address. The costumer can cancel the order without additional costs.
Right of withdrawal
For distance contracts, the customer has the right to notify the company at info@happyfrenchiepaw.com within 14 days of withdrawing from the contract without having to give a reason for his decision. This deadline starts to run from the day on which the consumer received the goods.
The buyer must not use the received goods unhindered in the time until the withdrawal from the contract. The buyer may only inspect and test the received goods to the extent strictly necessary to establish the actual situation. Any “testing” and other use that deviates from the above can be considered the use of the goods, which means that the buyer is responsible for reducing the value of the goods if the reduction of the value is due to unnecessary testing and use.
The buyer has no right to withdraw from the contract in contracts whose subject is an item that was made according to the precise instructions of the buyer (personalization of the item), which was adapted to his/her personal needs, which due to its nature is not suitable for return. In practice, this means that for all products made at the buyer’s request, the buyer can not return the product, but is obliged to pay under the contract. The seller is not responsible for incorrectly selected options (eg incorrectly selected type of personalized product, incorrect choice of personalization pattern, spelling errors, date errors, etc.) of the personalization at the time of purchase.
The buyer must return the goods to the company no later than 14 days after the notice of withdrawal from the order. The consumer returns the goods to the address: Happy Frenchie Paw, Darja Draksler s.p., Goriška ulica 16a, 2000 Maribor, Slovenia. The only cost borne by the consumer in connection with the withdrawal from the order is the direct cost of returning the goods.
The buyer must return the goods to the seller unused, undamaged, in unaltered quantity and in the original packaging, unless the product is destroyed, damaged, lost or its quantity has decreased without the fault of the buyer.
Upon returning the goods, the buyer also sends an invoice for the goods, personal data and a transaction account to which he wishes to receive the returned payment. Payment will be refunded no later than 14 days from receipt of unused, undamaged goods in the same quantity and in the original packaging.
The buyer bears the burden of the risk of loss, damage or destruction of the product he wishes to return, unless it occurred through no fault of his own.
If the promotional code was used, these funds are considered a discount and are not returned to the user. Only the paid amount is returned to the user’s bank account, and at the same time the promotional code is returned to the user in the form of a new promotional code.
Claiming a material defect
The seller is liable for material defects that the product had at the time it was passed to the buyer, regardless of whether he was aware of it or not. The seller is also liable for those material defects that appear after the item has passed to the buyer, if they are due to a cause that already existed before. A slight factual error is disregarded.
Items sold in the Happy Frenchie Paw online store have no warranty, but the user can file a complaint of material defect for every product purchased (which means that due to a defect in a product for which no warranty has been given, the buyer can enforce the rights arising from a material defect). The buyer must inform the seller within two months of the discovered material defect (for defects that appear on the product after two years from the previous period, then the seller no longer corresponds). The buyer can choose if he/she wants a refund, which can be the amount paid in proportion to the defect, replacement of the goods or refund of the amount paid.
The buyer must describe the defect in detail and allow the seller to inspect the product. If the defect is not disputable, the company must comply with the buyer’s request as soon as possible and within eight days after the product was returned at the latest. If there is a dispute about the defect, the company must give the buyer a written answer within the same period.

Happy Frenchie Paw does its best to ensure that the information published on its website is up-to-date and correct. Nevertheless, the characteristics of the items, the delivery time or the price may change so quickly that sometimes the Seller fails to correct the information in a timely manner. In such cases, Happy Frenchie Paw will notify the buyer of the changes and allow to withdraw from the contract or replace the ordered item.
Happy Frenchie Paw reserves the right to disable the website or disable access to it due to technical or other problems and maintenance, which also means disabling the use of the online store. In case of technical problems on the website, we reserve the right to cancel placed orders that have been affected by a technical error. In the event of order cancellation, we will notify customer as soon as possible and inform of the next steps. Costumer must ensure himself/herself that his computer is adequately protected. The user must ensure the appropriate security and confidentiality of the information used to log in to the website.
Complaints and disputes
Happy Frenchie Paw respects applicable European consumer protection law and makes every effort to fulfill its duty to set up an effective complaint handling system and to designate a person with whom the customer can contact by e-mail in the event of a problem.
The complaint is submitted via email to info@happyfrenchiepaw.com. The appeal procedure is confidential. Happy Frenchie Paw will acknowledge receipt of the complaint within seven working days, inform the customer how long it will take to deal with it and keep him informed of the progress of the procedure.
Happy Frenchie Paw is aware that an essential feature of a consumer dispute, at least as far as judicial resolution is concerned, is its disproportion between the economic value of the claim and the costs incurred in resolving the dispute itself. This is also the main obstacle to the consumer not initiating a dispute in court. That is why Happy Frenchie Paw strives to the best to resolve any disputes amicably.
Out-of-court settlement of consumer disputes
In accordance with legal norms, we do not recognize any provider of out-of-court settlement of consumer disputes as competent for resolving consumer disputes that could be initiated by the consumer in accordance with the Out-of-Court Settlement of Consumer Disputes Act. Happy Frenchie Paw, which as a provider of goods and services enables online shopping in Slovenia, publishes an electronic link to the online consumer dispute resolution platform (SRPS) on its website. The platform is available to consumers at the link HERE.
That regulation derives from the Out-of-Court Settlement of Consumer Disputes Act, Regulation (EU) no. Regulation (EC) No 524/2013 of the European Parliament and of the Council on the online settlement of consumer disputes and amending Regulation (EC) No 2016/2004 and Directive 2009/22 / EC.
Declaration of the legal status of the products
The seller does not assume any responsibility to the buyer for any delay and damage resulting from the delivery that is not possible to deliver.
An undeliverable shipment is a shipment that cannot be delivered for any of the following reasons, including but not limited to:
- The buyer’s address is incorrect or cannot be found,
- delivery is not possible due to unavailability or if the appropriate person who would pick up delivery or sign the delivery has refused the delivery at the time of the initial attempt or repeated attempts at delivery,
- the package cannot be cleared through customs.
The seller assumes no responsibility for shipments left to customs. The buyer is responsible for ensuring that the dispatched goods are suitable for entry into the country / territory of destination. The buyer agrees to inquire about the legal status of the items in the country where he is ordering.
The seller does not have documents that explicitly explain the legal status of items in certain countries.
The seller does not assume any responsibility to the buyer for any delay caused by delivery/transport.
Final provisions
Happy Frenchie Paw may change these general terms and conditions at any time in accordance with its decision. Happy Frenchie Paw will notify users of changes to the General Terms and Conditions in the usual reliable manner (by posting on the website). The user is considered to agree to the changes to the general terms and conditions if he / she continues to use the Happy Frenchie Paw website and online store after the publication of the changes.
These General Terms and Conditions shall enter into force on 22th July 2021.
